Terms of Service

1. About Cushty

Cushty Group Ltd ("Cushty", "we", "us") is registered in Scotland under company number SC887896. We provide an operations management platform for service businesses at cushty.io.
These Terms of Service ("Terms") govern your access to and use of the Cushty platform and website. By creating an account or using Cushty, you agree to be bound by these Terms.

You must be at least 18 years old to use Cushty.
If you are using Cushty on behalf of a business, you confirm you have the authority to bind that business to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate and complete information when registering and keep it up to date.

Cushty provides software for managing jobs, quotes, invoices, clients and team members.
We may update, change or discontinue features with reasonable advance notice. Where changes materially affect the service, we will give at least 30 days’ notice.
We aim for high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible.

You must not use Cushty to breach any applicable law or regulation.
You must not use Cushty to infringe on any third party’s intellectual property, privacy or other rights.
You must not upload, store or transmit malicious code, viruses or harmful content.
You must not attempt to gain unauthorised access to any part of the Cushty platform or its underlying systems.
We reserve the right to suspend or terminate accounts that violate these rules.

Cushty operates on a subscription basis. Fees are charged in advance on a monthly or annual cycle depending on your chosen plan.
By providing a payment method, you authorise us to charge the applicable fees on your billing date.
If a payment fails, we will notify you and attempt to re-charge. Continued non-payment may result in suspension of your account.
Cancellations take effect at the end of your current billing period. You will retain access until that date.
We do not issue refunds for partial billing periods unless required by law.
We reserve the right to change our pricing with 30 days’ written notice.

You retain ownership of all data you enter into Cushty, including client records, job data, quotes and invoices.
You grant us a limited licence to process that data solely to provide the Cushty service to you.
We act as a data processor for personal data you enter about your clients and team. You are the data controller for that data and remain responsible for your compliance with UK GDPR.
Our full Privacy Policy sets out how we handle personal data and is incorporated into these Terms by reference.

Cushty Group Ltd owns all rights to the Cushty platform, including its software, design, branding and documentation.
Nothing in these Terms grants you any rights in Cushty’s intellectual property beyond the limited right to use the service as described.
You must not copy, modify, reverse-engineer or redistribute any part of the Cushty platform.

To the maximum extent permitted by applicable law, Cushty’s total liability to you for any claim arising from your use of the service is limited to the fees you paid in the three months immediately prior to the claim.
We are not liable for indirect, incidental, special or consequential losses, including loss of profits, data or business opportunities.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

You may cancel your account at any time from your account settings or by contacting us at info@cushty.io.
We may suspend or terminate your account immediately if you breach these Terms or if we are required to do so by law.
On termination, your right to access the platform ceases. We will retain your data for up to 90 days before deletion, as described in our Privacy Policy.

We may update these Terms from time to time. We will notify you of material changes by email with at least 30 days’ notice before they take effect.
Continued use of the platform after the effective date of updated Terms constitutes your acceptance of those Terms.

These Terms are governed by the laws of Scotland.
Any dispute arising from these Terms or your use of Cushty will be subject to the exclusive jurisdiction of the Scottish courts, unless otherwise required by applicable consumer law.
